本使用條款及細則適用於日光僱傭中心(下稱“本公司”)www.brightlightemployment.com.hk 網站(下稱 “本網站”)的所有用戶。

本聲明事前毋須另行通知即可不時修訂,閣下應定期查閱最新版本。本公司承諾遵守《使用條款及細則》(下稱 “使用條款”)的責任及要求,屬下員工亦必須遵照條例規定的責任及要求。

此文件為一份具法律約束效力的協議書,請細心閱讀當中的使用條款。若閣下使用本公司的服務,包括本公司的流動應用程式及網站,即同意我們的使用條款。

服務範圍 / 內容

本公司是提供家庭傭工介紹服務的僱傭中心。本公司的服務專為僱主與外傭而設,妥善辦理履歷刊登、配對、處理聘用的程序。若閣下註冊你的登入資料或個人檔案,即表示同意與本公司訂立一份具法律約束力的協議。

使用條款

  • 當閣下使用本公司應用程式或網站時,你必須在尋找工作的國家中符合該國家的最低工作年齡要求;以及在你居住的國家中符合該國的最低聘用年齡要求。
  • 閣下若同意此服務使用條款,即允許本公司全權公開於履歷或工作廣告上列明的資料,當中包括個人詳細資料、電子郵件及手提電話號碼。閣下的地址只會用於辦理外傭申請或推廣資料的用途,本公司人不會在流動應用程式或網站上披露/公開有關地址。
  • 此應用程式或網站的各頁面內容僅向閣下提供一般資訊及讓閣下使用。內容隨時會予以更改,恕不另行通知。
  • 如閣下使用此應用程式或網站,本公司可能會要求你填寫一份網上註冊表格。提供真實,最新、完整及準確的資料,以便使用此應用程式或網站提供的服務。
  • 如本公司懷疑任何帳戶的擁有人有任何不敬、非法或危險的意圖,我們保留封鎖該帳戶的可能性,且不會就建立及管理此帳戶所收取的費用提供任何賠償。
  • 在任何特定的目的下,在應用程式或網站找到或提供的資訊及材料,本公司或任何第三方均不會就其準確度、合時性、表現、完整性或適合程度,提供任何保證及擔保。閣下知悉此等資訊及材料可能含有不準確或錯誤成份,而對於任何此等不準確或錯誤,我們在法律允許的最大程度下明確地不會承擔任何責任。
  • 閣下在使用此應用程式或網站的任何資訊或材料時,需完全自行承擔風險,我們不會對此負上責任。閣下需自行負責確保此應用程式及網站中任何提供的產品、服務或資訊符合你的特定要求。
  • 此應用程式及網站含有本公司擁有或持有版權的材料(包括但不限於數據、設計、編排、外貌、外觀及圖像)。本公司禁止任何人士複製此等材料。未經授權擅自使用任何本網站材料將屬違法。
  • 閣下使用此應用程式或網站,及任何因使用此應用程式或網站而引起的爭議,均受香港特別行政區法律監管。

義務

  • 閣下不得使用本公司的服務來傳送非本公司服務的宣傳訊息;不可要求任何客戶為任何服務付款。本公司保留暫停向你提供服務的權利。
  • 如閣下為一名求職者或僱主,便需在你建立的內容中 (包括履歷、個人檔案及私人訊息) 提供準確、正確和真實的資料。如當中內容有所更改,便需更新相關資料。所有用戶均需為任何披露的資料負上全部責任請勿披露任何你沒有權利披露的資訊。如有任何問題,我們保留提出控告的權利。
  • 閣下的個人檔案圖片必須展示你本人的容貌。若圖片中出現任何其他人士,則均需得到該等人士的批准。如你沒有該等人士的批准,你便需為任何損害負上全部責任。
  • 閣下不得以模仿其他人士或建立一個虛有身份的方式,亦不得替自己以外的任何其他人士建立個人檔案。如果你想協助朋友、親戚,家人或任何其他人士,你可以介紹本公司的服務給他們,但他們需要自行建立屬於自己的個人檔案。
  • 閣下有責任小心保管你的個人資料。請將你的用戶名稱保持機密,不要與其他人分享密碼,並做好安全保管的措施。本公司不會就任何個人資料的遺失負上責任。
  • 閣下必須對你遞交的圖像具有擁有權及使用權。任何含有淫穢、冒犯或成人內容成份的圖像均不獲接受。任何故意虛假及/或具誹謗、不準確、辱罵、騷擾、淫穢、褻瀆、與色情相關、威脅,或其他違反任何法律的材料均會被刪除。本公司保留權利,以暫停任何張貼含有冒犯內容成份的帳戶。
  • 閣下不得與其他人士共用帳戶或個人檔案。任何帳戶都只可由一位人士負責管理。另不得將會籍轉讓給朋友、家人或任何人士。
  • 閣下不得利用私人訊息、廣告或個人檔案頁面來銷售任何貨品、服務或任何事項。如發現任何人士違反此義務,我們會立即採取行動。
  • 閣下不得利用任何方法來複製其他人的個人檔案或廣告資料,當中包括利用各種科技工具或人手方式來複製。如果我們發現你出售任何資料或在你的資料庫中使用這些資料,本公司保留提出控告的權利。

權利

  • 本公司可以在自行決定下,更改、暫停或結束任何服務,或更改及修改價格。 我們的服務價格會根據由本公司全權決定的條款而定。一旦用戶將其資料張貼於網上,即不會獲得退款安排。
  • 會員 (不論是否為付款或非付款會員) 需對上載或提供任何不準確、不完整、帶有誤導、冒犯或非法成份的內容負上責任。
  • 本網站載有的篏入式內容(包括但不限於嵌入式文字、圖像、錄音及視頻),皆直接來自Facebook、YouTube或Instagram等第三者網站或社交媒體,本公司不會對任何張貼於第三方廣告或應用程式上的內容負上責任,亦不會為任何法律條款或私隱政策承擔責任。嵌入式內容、第三方廣告或應用程式受其所屬網站或網站經營者的條款約束所規管,閣下必須遵守其相關條款,方可使用或連結至該等內容。
  • 如本公司發現閣下的帳戶違反了任何我們的用戶權利,我們可能會暫停、限制或終止此等帳戶。在此情況下,我們將不會就建立及管理此帳戶所收取的費用提供任何賠償。
  • 閣下選擇應用或使用那些建議的合作代理或與我們有連結的網站,是完全屬於你的自行決定,並應自行承擔任何當中涉及的風險。我們將不會對任何發生的損壞/損失負上責任,但我們會盡力嘗試確保連結的網站及合作代理為可靠。
  • 本公司與合作代理及夥伴為各自獨立的個體。合作代理或合作夥伴有責任確保與你之間的通訊符合當地的法規。如果你決定訂購他們的套件服務,本公司並不會負上任何責任。你將需要與合作代理或夥伴簽訂合約,一旦出現意見分歧,便需自行與他們溝通。
  • 會員可能會從其他會員身上,收到有關其個人檔案詳情的訊息,或收到僱主的來電。本公司不會對任何訊息及來電中的內容負上責任。
  • 本公司保留權利,以在未經事先通知下隨時更改我們應用程式或網站及流動應用程式的內容。

免責聲明

  • 僱主、合作夥伴或合作代理應確保互相嚴格遵守相關法規,以及在符合相關法規之下商討外傭的薪酬、招聘代理費用,以及任何其他衍生的收費。
  • 本公司與應用程式及網站的所有用戶為各自獨立的個體,而我們不會為閣下與其他用戶之間的溝通,以及因使用我們的服務而負上責任。
  • 此應用程式或網站可能會不時含有前往其他網站的連結。此等連結是在方便你的基礎下為你提供更多資訊,但並不表示我們支持此等網站。我們不會對連結網站的內容負上責任。
  • 在網上使用服務時,或與平台上認識的用戶以離線方式會面期間發生任何的安全問題,本公司都不會負上責任。我們建議所有客戶應制訂所需的預防措施,以保護人身安全。
  • 我們不會就閣下決定使用其中一間合作夥伴 (亦即為處理保險、醫療檢查及機票的合作代理),而負責當中的任何成本或損失。與此合作夥伴簽訂合約前,請先要求他們完成所有法定文件,並確保其持有適當的牌照。閣下與他們的任何溝通乃你與第三方的事宜,本公司將不會因任何出現的結果負上責任。
  • 如因使用本公司的網站而招致任何損害或成本,本公司不會承擔責任。不論是直接聘用或使用我們的合作夥伴,你都有責任確保你的決定和行動均符合當地的法規。
  • 本公司不會保證其服務不會出現錯誤或中斷情況。我們不會應因這些問題而出現的困擾負上任何責任。
  • 本公司不會就任何特別的、引致的及懲罰性的損害、附帶事件、間接事件、資料損失、含冒犯或誹謗的字眼,而對閣下或其他人士負上責任。
  • 不論閣下的地理居住地點或在何處使用我們的服務,萬一我們最終面臨法律糾紛,此糾紛將於香港法院內依照香港法律來處理。

索賠事項

如因閣下涉及違反該等使用條款以及/或閣下使用本網站,以致本公司及其母公司的僱員、代理人、董事、承辦商、供應商及其他代表或其他合夥人,承受任何債務、損害賠償、索償、訴訟、成本及支出﹙包括法律費用﹚,閣下同意為彼等抗辯及作出補償,使免遭受損失。如有需要,在任何索賠、訴訟及和解商議中,本公司亦可參與抗辯。未得本公司書面批准,閣下不得作出任何可能對本公司的權利或責任構成不利影響的和解。本公司保留權利,經通知閣下後,由本公司自費獨自抗辯及控制任何索償或訴訟。閣下謹此同意就閣下對本網站之任何材料的任何可能未經授權的使用向本公司作出賠償,爲本公司進行抗辯並使不受其之影響。

適用法律及管轄權

本使用條款將依據並以中華人民共和國香港特別行政區( “香港”)法律解釋,且受香港法的專屬性管轄權。閣下同意將本公司與閣下之任何糾紛、爭議或索償交由香港法院審理。

These Terms and Conditions are applicable to all users who visit the website of Bright Light Employment Agency (hereinafter referred to as “BLEA”) : www.brightlightemployment.com.hk (hereinafter referred to as “this website”).

This statement can be revised from time to time without prior notice. You should check the latest version regularly. BLEA undertakes to comply with the responsibilities and requirements of the Terms and Conditions (hereinafter referred to as the “Terms”) and its employees must comply with the duties and requirements set out in the Ordinance.

This document is a legally binding agreement, please read the Terms carefully. By using our services, including our mobile applications and websites, you agree to our Terms.

Scope of Services / Content

BLEA is an online platform for renewing FDHs and matching employers and domestic helpers. Our services are designed for employers and FDHs to properly handle the procedures of job advertisement, matching and employment. By registering your login information, work information or profile, you agree to enter into a legally binding agreement with us.

BLEA is an employment agency that provides referral services of domestic helpers to our customer. BLEA’s services are designed for employers and FDHs to properly handle the procedures of resume publication, matching and employment processing. By registering your login details or profile, you agree to enter into a legally binding agreement with us.

Terms of Use

  • When you use the App or Website, you must meet the minimum working age requirement in the country in which you are seeking employment; and meet the minimum age requirement for employment in your country of residence.
  • By agreeing to these Terms of Use, you grant BLEA full authority to disclose the information set out in your resume or job advertisement, including personal details, email address and mobile phone number. Your address will only be used for the purpose of applying for FDHs or marketing materials, and we will not disclose / publish the related address on the mobile application or website.
  • The content of the pages of this application or website is provided to you only for general information and for general use. The content is subject to change at any time without prior
  • If you use this application or website, we may ask you to complete an online registration form. To provide true, current, complete and accurate data in order to use the services provided by this application or website.
  • If BLEA suspects that the owner of any account has any disrespectful, illegal or dangerous intentions, we reserve the possibility of blocking the account and will not provide any compensation for the fees charged for the establishment and management of such account.
  • Neither BLEA nor any third party can guarantee to the accuracy, timeliness, performance, completeness or suitability of information and materials found or provided on the App or Website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly disclaim any liability for any such inaccuracies or errors to the fullest extent permitted by law.
  • Your use of any information or materials on this application or website is entirely at your own risk and we are not responsible for it. You are solely responsible for ensuring that any products, services or information offered in this application and website meet your specific requirements.
  • The App and Website contain material (including but not limited to data, design, layout, appearance, outlook and graphics) owned or held by BLEA. Any unauthorized use of the materials on this website is unlawful.
  • Your use of the App or Website, and any dispute arising out of your use of the App or Website shall be governed by the laws of the Hong Kong Special Administrative Region.

Obligation

  • You may not use our Services to send promotional messages that are not relevant to our Services; No Payment is required from our customers for any Services provided by you. BLEA reserves the right to suspend the provision of services to you.
  • If you are a FDHs or employer, you are required to provide accurate, correct and truthful information in the content you create (including resumes, profiles and private messages). If there are any changes, the relevant information will need to be updated. All users are solely responsible for any information disclosed and do not disclose any information that you do not have the right to disclose. We reserve the right to lodge a legal action if there are any questions.
  • Your profile picture must show your appearance. Any other person appearing in the image requires the approval of that person. If you do not have the approval of such persons, you are fully responsible for any damages.
  • You must not impersonate another person or create a counterfeit identity, nor may you create a profile for anyone other than yourself. If you want to assist friends, relatives, family or any other person, you can introduce our services to them, but they will need to create their own personal profile.
  • It is your responsibility to take care of your personal data. Keep your username confidential, don’t share your password with anyone else, and keep it safe. BLEA will not be liable for any loss of personal data.
  • You must own and use the images you submit. Any images that contain obscene, offensive or adult content will not be accepted. Any material that is intentionally false and/or defamatory, inaccurate, abusive, harassing, obscene, profane, pornographic, threatening, or otherwise contrary to any law will be removed. BLEA reserves the right to suspend any account that posts offensive content.
  • You may not share your account or profile with anyone else. Any account can only be managed by one person. Membership may not be transferred to friends, family or any person.
  • You may not use private messages, advertisements or profile pages to sell any goods, services or any matter. If we find that any person is in breach of this obligation, we will take immediate action.
  • You may not use any means to copy other people’s personal files or resumes, including using various technological tools or manual means. If we discover that you sell any information or use it in your database, we reserve the right to file a legal action.

Right

  • BLEA may, at its sole discretion, change, suspend or discontinue any of the Services, or change and modify the price. The price of our services will be determined by BLEA in its sole discretion. Once users post their information online, no refund will be granted.
  • Members (whether paid or non-paying) are responsible for uploading or providing any content that is inaccurate, incomplete, misleading, offensive or illegal.
  • BLEA is not responsible for any content posted on third-party advertisements or applications, nor for any legal terms or privacy policies. You expressly agree to the User Agreement for the Third Party Service
  • The Embedded content (including but not limited to embedded text, images, audio recordings and videos) contained in this website is obtained directly from third party websites such as Facebook, YouTube or Instagram or other social media companies, and BLEA is not responsible for any content posted on third party advertisements or applications, nor for any legal terms or privacy policies. Embedded content, third-party advertisements or applications are subject to the license terms of the location at which such content are hosted or the license terms imposed by the owner of such content and you must comply with their terms in order to use or link to such content.
  • If we find that your account violates any of our user rights, we may suspend, restrict or terminate such account. Under this circumstance, we will not provide any compensation for the fees charged for the establishment and management of this account.
  • Your choice to use the recommended business partners or websites linked to us is entirely at your own discretion and at your own risk. BLEA will not be liable for any damages / losses incurred, but BLEA will do our best to try to ensure that the linked sites and affiliates are reliable.
  • BLEA and the business partners are respective independent standalone companies. It is the partner’s responsibility to ensure that communications with you comply with local regulations. If you decide to order their services, we will not be responsible. You will need to enter into an agreement with the business partners you work with, and you will need to communicate with them yourself in the event of a disagreement.
  • Members may receive messages from other Members with details of their profile or calls from employers. BLEA is not responsible for the content of those messages and calls.
  • BLEA reserves the right to change the content of our App and websites at any time without prior notice.

Disclaimer

  • Employers and the business partners should ensure that they strictly comply with the relevant laws and regulations, and negotiate the remuneration of FDHs, agency fees and any other extra fees in compliance with the relevant laws and regulations.
  • BLEA and all users of the App and Website are standalone individuals, and we are not responsible for your communication with other users or for your use of our services.
  • This App or website may, from time to time, contain links to other websites. These links are provided for your convenience and do not imply endorsement of such websites. We are not responsible for the content of linked websites.
  • BLEA is not responsible for any security problems that occur when using the Services online or during offline meetings with users met in the company. We recommend that all customers should conduct necessary precautions to protect their personal safety.
  • We will not be liable for any costs or losses arising out of your decision to use one of the business partners (i.e. the co-agent who handles insurance, medical examinations and air tickets). Before entering into an agreement with this agent, ask them to complete all statutory documents and ensure they hold the appropriate licenses. Any communication between you and them is a matter between you and a third party and we will not be liable for any consequence.
  • BLEA shall not be liable for any damages or costs incurred by means of the use of BLEA’s website. Whether you hire directly or use one of our business partners, it is your responsibility to ensure that your decisions and actions comply with local regulations.
  • BLEA does not guarantee that its services will be error-free or uninterrupted. We are not responsible for any problems that arise from these issues.
  • BLEA shall not be liable to you or any other person for any special, consequential or punitive damages, incidental circumstance, indirect circumstance, loss of information, offensive or defamatory words.
  • Regardless of your geographical residence or where you use our services, in the unlikely circumstance that we end up facing a legal dispute, such dispute will be dealt with in the courts of Hong Kong in accordance with the laws of Hong Kong.

Indemnity

You agree to defend and indemnify the employees, agents, directors, contractors, suppliers and other representatives or other partners of BLEA and its parent company from and against any liabilities, damages, claims, actions, costs and expenses (including legal fees) arising out of your breach of these Terms of Use and / or your use of the Website. If necessary, the Company may also participate in the defense of any claims, litigation and settlement negotiations. Without the written approval of BLEA, you shall not make any settlement that may adversely affect BLEA’s rights or liabilities. BLEA reserves the right, upon notice to you, to defend and control any claim or proceeding at BLEA’s sole expense. You hereby agree to indemnify, defend and hold harmless BLEA from and against any possible unauthorized use by you of any materials on this website.

Applicable Law and Jurisdiction

These Terms of Use shall be construed according to the laws of Hong Kong Special Administrative Region of the People’s Republic of China (“Hong Kong”) and be governed by the exclusive jurisdiction of the Hong Kong Court. You agree to submit to the jurisdiction of Hong Kong courts for any disagreement, dispute or claim between BLEA and you.
